Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Niche Locate (“Niche Locate,” “we,” “us”) governing your use of our website, app, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Niche Locate is an AI-powered research tool that generates business niche ideas, scores them across multiple factors, and produces reports and validation plans based on the information you provide. The Service includes a free tier with a limited number of niche searches and a paid subscription (“Pro”) with expanded features such as unlimited searches and deep-dive reports.

2. Not professional advice

The Service provides AI-generated informational content only. It is not business, financial, investment, legal, tax, or other professional advice, and no output constitutes a guarantee of business success or income. Scores, recommendations, market descriptions, and validation plans are automated estimates that may be incomplete, outdated, or wrong. You are solely responsible for independently verifying any information before acting on it and for all decisions you make, including decisions to start, fund, or operate a business. Consult qualified professionals where appropriate.

3. Accounts

You must provide a valid email address and keep your account access secure. You are responsible for all activity under your account.
You must be at least 16 years old (or the age of digital consent where you live) to use the Service.
We may suspend or terminate accounts that violate these Terms, abuse the Service (including attempts to circumvent usage limits, rate limits, or security controls), or create risk for us or other users.

4. Subscriptions, billing, and cancellation

Paid subscriptions are billed monthly in advance through Stripe at the price shown at checkout, plus applicable taxes.
Subscriptions renew automatically each billing period until cancelled.
You can cancel any time via “Manage billing” in your dashboard. Cancellation takes effect at the end of the current billing period; you keep Pro access until then. We do not provide prorated refunds for partial periods, except where required by law.
We may change prices with at least 14 days' notice; changes apply from your next billing period. If you don't accept a price change, cancel before it takes effect.
Free-tier usage (e.g., a limited number of niche searches) may be adjusted from time to time.

5. Your content

You retain ownership of the information you submit (your search inputs, notes, and saved projects). You grant us a limited license to host, process, and display that content as needed to operate the Service — including sending your search inputs to our AI provider to generate your results. You are responsible for ensuring you have the right to submit what you submit.

6. AI-generated output

Subject to these Terms and applicable law, you may use the reports and recommendations generated for you in your own business. AI output may be similar to output generated for other users — exclusivity is not guaranteed. You may not represent AI-generated output as independent human research when reselling it.

7. Acceptable use

No unlawful, infringing, or fraudulent use of the Service.
No attempts to probe, scrape, reverse-engineer, or bypass security, rate limits, plan gates, or usage quotas.
No reselling or white-labeling the Service itself without our written agreement.
No submitting content you don't have the right to submit, or using the Service to generate content that violates others' rights.

8. Intellectual property

The Service — including our software, scoring methodology, design, branding, and blog content — is owned by Niche Locate and protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

9. Third-party services

The Service depends on third-party providers (including Supabase, Stripe, Anthropic, and Vercel). We are not responsible for outages or changes in those services, but we will make reasonable efforts to keep the Service available and to remedy disruptions.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHE LOCATE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING DECISIONS MADE IN RELIANCE ON AI-GENERATED OUTPUT. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

13. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate the Service or your account for breach of these Terms, with notice where practicable. Sections that by their nature should survive termination (including Sections 2, 5, 6, 8, and 10–14) survive.

14. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which Niche Locate is established, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that state, and each party consents to their jurisdiction. You and Niche Locate each waive any right to a jury trial and agree claims may be brought only individually, not as a class action, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. For material changes we will update the effective date above and, where appropriate, notify you by email or in the app. Continued use of the Service after changes take effect constitutes acceptance.
